This limited product warranty (“Warranty”) is given by Benbria Corporation and Benbria Inc. (“Benbria”) solely with respect to hardware products manufactured or resold by Benbria (“Products”) to the original purchaser of the Product (“Customer”).

What Does This Warranty Cover?

This Warranty extends only to the Customer who purchases the Product for their own use from Benbria or an authorized Benbria reseller. This Warranty covers any defects in material or workmanship in the Product when delivered to the Customer in new condition in its original packaging. The sole and exclusive remedy of the Customer, and the entire liability of Benbria under this Warranty will be, at Benbria’s option, the repair or replacement of the Product in accordance with the return process described below.

How Long Does The Coverage Last?

For all non-electronic components, the Warranty period is for one year.
For all electronic components, the Warranty period is for six months.

What Does This Warranty Not Cover?

This Warranty does not cover any problem that is caused by: (a) failure of electrical components or accessories due to the operating environment (such as electrical surges, airborne grease accumulation, excess humidity, extreme heat or cold, submersion in fluid, corrosive or other abnormal environmental conditions); (b) accident, abuse, neglect or misuse, including any use contrary to operating instructions or beyond Product specifications; (c) installation, operation, maintenance or unauthorized modification or alteration; (d) theft, vandalism or impacts by a person or foreign object outside of normal use; or (e) servicing by unauthorized persons. This Warranty is void if a Product is returned with removed, damaged or tampered labels or any unauthorized modification or alteration (including the unauthorized removal of any component, serial number or identification mark). This Warranty does not cover normal wear and tear, including chips, scratches, abrasions, discolorations or fading on faceplates, dead pixels, frames, tablet inserts, housing, connectors, screws, bolts, cases, tools, accessories or paint/finishes.

THIS WARRANTY DOES NOT COVER, AND BENBRIA WILL NOT BE LIABLE TO CUSTOMER OR ANYONE ELSE FOR, ANY DAMAGES RESULTING FROM THE USE OR MISUSE OF, OR INABILITY TO USE, ANY BENBRIA PRODUCT, INCLUDING BUT NOT LIMITED TO: LOSS OF REVENUES, SAVINGS OR PROFITS, LOSS OF USE OR INCONVENIENCE, EXPENSE FOR SUBSTITUTE EQUIPMENT OR SERVICE, STORAGE CHARGES, LOSS OR CORRUPTION OF DATA, DAMAGE TO OTHER EQUIPMENT OR ANY OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY THE USE OR MISUSE OF, OR INABILITY TO USE, A PRODUCT, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, AND EVEN IF BENBRIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL BENBRIA BE LIABLE FOR MORE THAN THE AMOUNT OF CUSTOMER PRODUCT PURCHASE PRICE, NOT TO EXCEED THE CURRENT LIST PRICE OF THE PRODUCT. EXCEPT AS SPECIFICALLY PROVIDED IN THIS WARRANTY STATEMENT, BENBRIA SPECIFICALLY DISCLAIMS ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, WARRANTIES AND GUARANTEES, AND SPECIFICALLY DISCLAIMS THE APPLICATION OF THE UN CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS. ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM A COURSE OF DEALING, LAW, USAGE, OR TRADE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW AND ARE EXPRESSLY DISCLAIMED. TO THE EXTENT AN IMPLIED WARRANTY CANNOT BE EXCLUDED, SUCH WARRANTY IS LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD PROVIDED IN THIS WARRANTY STATEMENT. NO EXPRESS WARRANTY OR GUARANTEE GIVEN BY ANY PERSON OR ENTITY OTHER THAN BENBRIA WITH RESPECT TO A PRODUCT WILL BIND BENBRIA.

What Do You Have To Do?

Benbria will not provide any Warranty coverage unless your claim is in compliance with all terms of this Warranty statement and you follow proper return procedures. To request Warranty service, please follow the Benbria RMA procedure as outlined below.

RMA Procedure:

  1. First, attempt to troubleshoot the issue using the Benbria Knowledge Base and troubleshooting procedures as provided by Benbria (available at support.benbria.com).

  2. If troubleshooting fails to resolve the issue and you believe the Product requires RMA, please contact Benbria support and provide a detailed description of the issue.

  3. Once Benbria determines that a repair or replacement is required, you will be prompted for your name, address, phone number, e-mail, Benbria Account Number, original Order Number and then issued a Return Merchandise Authorization (RMA) number to use when returning the Product. Product you return to Benbria must be properly packaged in its original packaging (or packaging providing the Product with protection equivalent to the original packaging to withstand the hazards of shipment) and shipped, fully insured, with all shipping charges and related fees (including any applicable customs clearance fees or duties) prepaid by you, via a shipping method that provides for tracking of your package, to the address provided when you received your RMA number. If you do not receive a specific return address with your RMA number the following address should be used:

    All Product returns must be to the attention of RMA and have the RMA number included and visible on the outside of the packaging. RMAs are valid only if the return package is shipped within 10 business days after the RMA number is issued.

  4. If you were given an RMA number, if Benbria receives and if Benbria acknowledges receipt of the product, Benbria will, at its sole discretion, either repair or replace your Product without charge with a functionally equivalent Product using new or refurbished components. You will be responsible for the cost of shipping the repaired or replacement Product back to you (including any applicable customs clearance fees or duties). If Benbria ships a replacement Product to you, you agree to transfer ownership of the original Product to Benbria, and Benbria will not return your original Product to you. Benbria warrants that repaired or replaced Products are covered [for the greater of either the remainder of the original Product warranty or 90 days].

Does Your Domestic Law Apply?

The laws of the Province of Ontario, Canada, govern this Warranty, notwithstanding any conflicts of law provisions, and the courts of the Province of Ontario shall have exclusive jurisdiction over any claim arising under this Warranty. This Warranty gives you specific legal rights, however you may also have other rights under applicable laws in your jurisdiction, and under such laws certain limitations or exclusions contained in this Warranty statement may not apply to you.

Airline and/or Commercial Carriers

This Warranty excludes any damage by Airlines or Commercial Carriers. Airlines or Commercial Carriers occasionally put containers/packages in situations beyond reasonable care and handling. If damage should occur during handling or transportation by an Airline or Commercial Carrier, it is your responsibility to file a claim directly with the Airline or Commercial Carrier.
